The Department of Labor’s Wage and Hour division enforces compliance with the Fair Labor Standards Act, including laws regarding overtime pay, minimum wage, and child labor, as well as the Family and Medical Leave Act (FMLA). State laws, including the North Carolina Wage and Hour Act also grant employees protection and set additional requirements employers must meet.
The most common wage and hour dispute cases are related to overtime pay, the definition of an exempt employee, and when time should count toward work hours (for example, travel time). While most non-salaried workers are aware they should be paid time and a half for hours worked in excess of 40 per week, there are times when salaried employees should also be paid overtime.
The Department of Labor now offers a series of wage and hour videos in English and Spanish that discuss topics of interest. The North Carolina Department of Labor has published a downloadable Handy Reference Guide to the North Carolina Wage and Hour Act that you may also find helpful.
